In a civil suit filed in the District Court of New Jersey by one of its subsidiaries, T-Mobile is seeking injunctive relief from a building owner, 390 George Street Associates (Defendant), for its refusal to let T-Mobile perform needed modifications to its equipment installed on the rooftop of the Defendant’s building located in New Brunswick, NJ. The denial is being made even though the long-established lease between the two parties expressly allows for such modifications. T-Mobile claims that the Defendant is unreasonably denying access to the site and creating conditions that prevent T-Mobile from making the site modifications by imposing arbitrary demands that go beyond anything ever agreed to in the lease.
